Traffic Violations

Speeding
A speeding conviction adds 3 to 11 points to your license depending on how far over the limit you were going. Fines increase significantly at higher speeds, and 6 or more points within 18 months triggers a Driver Responsibility Assessment (DRA) of $300 or more paid directly to the DMV on top of your court fine. We work to reduce the charge, the points, or both.

School Zone Speeding
Fines are doubled in designated school zones. Point exposure is the same as standard speeding: 3 points for 1–10 mph over the limit, up to 11 points for 40+ mph over. Note: school zone speed camera tickets carry no points and are civil penalties only. Officer-issued school zone speeding tickets carry full points and require the same defense as any speeding charge.

Cell Phone / Handheld Device
A conviction for handheld cell phone or texting while driving carries 5 points and fines up to $200 for a first offense, up to $450 for a third offense within 18 months. Drivers under 21 with a probationary or junior license face a 120-day suspension on the first conviction. We work to reduce the charge and avoid the points.

Red Light / Disobey Traffic Control Device
An officer-issued red light or disobey traffic control device conviction carries 3 points. Camera-issued red light violations carry no points but are civil penalties assessed to the vehicle owner. Officer-issued tickets are the ones that require a defense. One of the highest-volume ticket types in Suffolk and Nassau Counties.

Reckless Driving
Reckless driving carries 5 points and is a misdemeanor in New York, meaning it creates a criminal record, not just a traffic record. It also counts as a federally defined serious traffic violation for CDL holders. Two serious violations within 3 years triggers a minimum 60-day CDL suspension. We work to reduce the charge and its consequences.

Moving Violations
Improper lane changes, failure to yield, unsafe turns, and following too closely each carry 2 to 4 points. Tailgating (following too closely) is 4 points. Improper passing or unsafe lane change is 3 points. Points accumulate across violations, and reaching the suspension threshold can mean losing your license. We work to reduce charges and minimize point exposure.

Street Racing / Speed Contest
A speed contest or racing conviction carries 5 points and can also support a reckless driving charge. Significant fines apply. Defense strategies may be available depending on the circumstances of the stop.

Leaving the Scene (Property Damage)
Leaving the scene of a property damage accident carries 3 points and is a traffic violation with civil liability exposure. Leaving the scene of a personal injury accident is a separate, more serious charge: 5 points, a criminal charge, and a mandatory minimum 6-month license revocation. Suspended License
Operating on a suspended license can result in AUO charges (see below). Failure to respond to the original ticket that caused the suspension also results in an indefinite additional suspension. We work toward reinstatement and charge reduction, and address the underlying suspension cause.

Aggravated Unlicensed Operation (AUO)
AUO is driving while your license is suspended or revoked. It carries 11 points and is a criminal offense: a misdemeanor in the first and second degree, and a felony in the first degree. Mandatory fines range from $200 to $5,000. Your vehicle may be seized and forfeited. Do not handle this without an attorney.

No Insurance / Uninsured Operation
Operating an uninsured vehicle or being involved in a crash without insurance triggers a mandatory minimum 1-year license revocation and a $750 DMV civil penalty. These are separate from any court fine. Representation may limit further exposure and address the path to reinstatement.

Suspended / Revoked Registration
Commonly issued alongside no-insurance violations. The registration consequences and the license consequences are handled through different DMV processes. We address both the ticket and the administrative reinstatement steps.

DMV Hearings & Safety Hearings
The Driver Responsibility Assessment (DRA) is triggered when you accumulate 6 or more points within any 18-month period: $100 per year for 3 years, plus $25 per point above 6. An alcohol conviction triggers a separate $250/year DRA for 3 years regardless of points. DMV Safety Hearings are separate proceedings from traffic court and require their own defense strategy. Failure to pay the DRA results in license suspension.

NY Zero Tolerance Law (Under 21)
Any measurable BAC between .02 and .07 triggers a Zero Tolerance proceeding for drivers under 21. This is a DMV administrative hearing, not a criminal court case. A first offense results in a 6-month suspension and a $125 civil penalty plus a $100 suspension termination fee. A second offense results in a revocation for 1 year or until age 21, whichever is longer. Attorney representation at the DMV hearing can make a material difference in the outcome.

DWI / DWAI
New York imposes mandatory license revocations starting at 90 days for DWAI (alcohol) and 6 months for DWI or DWAI-Drug on a first offense. A second DWI within 10 years triggers a minimum 1-year revocation. Aggravated DWI (.18+ BAC) starts at a 1-year revocation on the first offense. An alcohol conviction also triggers a DRA of $250/year for 3 years paid to the DMV. The stakes include your license, your record, your insurance rates, and your employment. CDL & Commercial Drivers

CDL Violations
Federal FMCSA rules apply on top of state rules for CDL holders. Two federally defined serious traffic violations within 3 years triggers a minimum 60-day CDL suspension. Three within 3 years is a minimum 120-day suspension. Serious violations include: speeding 15+ mph over the limit, reckless driving, improper lane change, following too closely, and operating without a CDL. These disqualifications apply to violations in any state and are separate from NY DMV points. CDL holders also face a .04 BAC standard while operating a commercial vehicle. Never plead guilty to any moving violation without CDL-specific analysis.
